أركان المسؤولية العقدية وشروط قيامها - دراسة تأصيلية -

الملخص
يدرس هذا البحث مبحثا مهما من مباحث نظرية الالتزام؛ يتعلق بالمسؤولية العقدية، ويهدف إلى تحديد العناصر الواجب توافرها لقيام المسؤولية العقدية، وبيان تراوح هذه العناصر بين الركنية والشرطية عند فقهاء القانون؛ وتأصيل ذلك، كما يهدف إلى تحليل وتفصيل هذه العناصر، وبيان أسس كل منها وطريقة إثباته، مع الإشارة إلى أهمية العلاقة بينها وبين المسؤولية الناشئة عن عدم تنفيذ الالتزام، ومن أهم نتائج البحث أنّ المسؤولية العقدية تقوم بتوافر ثلاثة عناصر وهي، الخطأ العقدي، الضرر العقدي، والعلاقة السببية بين الخطأ والضرر، واختلف فقهاء القانون في تكييفها، فمنهم من اعتبر هذه العناصر أركانًا، ومنهم من اعتبرها شروطا، ويُمكن إطلاق وصف الشروط عليها، لكن وسمها بالأركان يشير أكثر إلى مدى أهميتها، وهو ما ذهب إليه الجمهور من فقهاء القانون المدني وشرّاحه وعلى رأسهم السنهوري. This research studies an important topic of commitment theory, regarding contractual liability. It aims to identify the elements that must be available for the establishment of contractual liability, and to explain how these elements range between the pillars and the conditions according to the jurists of law, and rooting it. It also aims to analyze and detail these elements, and to statement of the foundations of each of these and the method of proving it. Noting the importance of the relationship between it and the liability arising from failure to implement the obligation. Among the most important results of the research is that contractual liability is based on the availability of three elements, the contractual fault, the contractual damage, and the causal relationship between the fault and the damage. Jurisprudents differed in its adaptation. Some of them considered these elements as pillars. Some of them considered it a condition. These elements can be described by “conditions”. But naming it “the pillars” indicates more of its importance. This is what the majority of civil law jurists and commentators went to, led by Al-Sanhouri
