الملخص
ضع يدرسُ هذا البحث مسألة تقليد المفضول وأقوال الفقهاء فيها وبيان الراجح منها، وتهدفُ الدراسة إلى جمع الآراء المتعلقة بالمسألة والمتناثرة في كتب الفقه والأصول، كما تهدفُ إلى الوصول إلى الراجح في المسألة بعرض أدلة المُجيزين والمانعين ومناقشتها، وقد جاءت مقسّمة إلى قسمين اثنين؛ القسم الأول تطرق لبيان معنى التقليد وتحديد المقصود بالمفضول، والثاني جاء فيه اختلاف الفقهاء في المسألة وأدلة كل رأي، كما تم فيه الترجيح بين الأقوال، ومن أهم نتائج البحث أن تقليد المفضول مع وجود الفاضل جائز لعمل الصحابة رضي الله عنهم به بلا منكر، وذلك من باب التيسير على الناس في طلب الفتوى من جهة ومن باب رفع مشقة تتبع الأفضلية وما قد يعتريها من عصبية وغلو من جهة أخرى. This research studies the issue of imitating the preferred and the sayings of the jurists therein, and clarifies the most correct of them. The study aims to collect opinions on the issue that are scattered in the books of Fiqh and Usul, and it also aims to reach the most correct in the issue by presenting and discussing the evidence of cons and pros. It was divided into two parts. The first section dealt with clarifying the meaning of imitation and defining what is meant by preferred. The second presented how the jurists differed in the issue and the evidence for each opinion, as it was the weighting between the sayings. The most important result of the research is that the imitation of the preferred with the presence of the virtuous is permissible for the work of the Companions, may God be pleased with them, without an objection. That is to make it easier for people to request a fatwa on the one hand. And to lift the hardship of pursuing preference and the nervousness and hyperbole on the other hand that may be going on
