أهمية الحس الجنائي في الدستور؛ قراءة في دستور الجزائر 2020م

الملخص
يدرس هذا البحث أهمية تفعيل الحس الجنائي في النصوص الدستورية، ويهدف إلى الإشارة إلى ضرورة الجمع بين الترغيب والترهيب في القوانين الأساسية كالدساتير، وبيان دور الألفاظ الجنائية في دعم النصوص الدستورية، كما يهدف إلى تحليل جملة من النصوص ذات الصبغة الجنائية من دستور الجزائر 2020م، ليتم من خلالها استقراء كيفية تفعيل المشرع الجزائري للحسّ الجنائي في الدستور، ومن أهم النتائج التي توصل إليها البحث أنّ الحس الجنائي هو الإشعار الذي تتركه الألفاظ الجنائية في نفس المتلقي، وقد وظّف المشرع الجزائري اللغة الجنائية في بعض النصوص من دستور 2020م، ولم يكن هذا التوظيف اعتباطا، فالحس الجنائي للفظ المستعمل يضفي على النص صورة قوية ويعضّد مقصده، ويفرض احترام الدستور ويحقق الزجر، كما يعدُّ مستندًا تشريعيّا للاجتهادات القضائية في الموضوع، بالإضافة إلى أنّ هذا النوع من النصوص الدستورية يمثل أسسا للتشريع العقابي. This research studies the importance of activating the criminal sense in the constitutional texts. It aims to point out the need to combine encouragement and intimidation in basic laws such as constitutions. In addition, explaining the role of criminal expressions in supporting constitutional texts. It also aims to analyze some texts that contain a criminal formula from the Algerian Constitution 2020. In order to extrapolate how the Algerian legislator activates the criminal sense in the constitution. Among the most important results of the research is that the criminal sense is the feeling left by criminal expressions in soul of the recipient. The Algerian legislator employed the criminal language in some texts of the constitution 2020. This activation was not accidental. The criminal sense of the term used gives the text a strong significance and reinforces its purpose. It imposes respect for the constitution and achieves rebuke. It is also a legislative document for jurisprudence on the subject. In addition, this type of constitutional texts represent the basis for punitive legislation
