الملخص
يدرسُ هذا البحثُ مسألةً فقهيّةً تتمثل في ارتباط الرجل بعِدّة مُطّلقَتِه في زواجه، وتهدفُ الدّراسة إلى بيان حكم إلزام الرجل بالانتظار مدة العدة حتى يتزوج، وبيان مدى صحة تسمية هذه المدة بعدة الرجل، كما يهدفُ إلى بيان حالات عدة الرجل في الفقه الإسلامي وقانون الأسرة الجزائري، ومن أهمّ النتائج التي توصلت إليها الدراسة أنّ مصطلح عدّة الرجل يُطلق مجازًا، وهي حالات خاصة يُلزم فيه الرجل بانتظار عدّة مطلّقته حتى تنقضي ليتزوّج، وهما حالتان أساسيتان؛ الأولى له أربع زوجات طلّق إحداهنّ، والثانية طلّق زوجته وأراد الزواج بمن يَحرُمُ جمعها معها. This research studies a jurisprudential issue that is represented in the relationship of a man to iddah of his divorced women in his marriage, and the study aims to explain the ruling on obliging a man to wait period of iddah until he marries, and to show the validity of naming this period with the man’s iddah. It also aims to explain cases of man’s iddah in Islamic jurisprudence and Algerian family law. One of the most important findings of the study is that the term a man’s iddah is used metaphorically. In addition, they are special cases in which a man is obliged to wait period iddah of his divorced woman to expire, in order to married. And these are two basic cases; The first: has four wives, one of whom has divorced, and the second: divorces his wife and wants to marry someone who is forbidden to have with her
