الضوابط الشرعية لاستعمال الوجاهة في الـمعاملات الاجتماعية

الملخص
يدرسُ هذا البحث الوجاهة وضوابط استعمالها في الشريعة الإسلامية، ويهدف إلى تحديد المقصود بالوجاهة مع بيان أسسها، وكذا الإشارة إلى دور الشريعة الإسلامية في تفعيلها ضمن المعاملات الاجتماعية، كما يهدف إلى تحليل بعض الصور الإيجابية والسلبية للوجاهة وتعليلها، واستقراء الضوابط الشرعية لاستعمال الوجاهة في المعاملة، ومن أهم نتائج البحث أنّ الوجاهة هي المكانة الاجتماعية التي يكون صاحبها موضع ثقة واحترام عند الناس، وقد ضبطت الشريعةُ الإسلامية استعمال هذه المكانة في المعاملات الاجتماعية بعدة شروط أهمّها: أنْ لا تستعمل فيما فيه ضرر، وأن تقدم المصلحة العامة على المصلحة الخاصة، وأنْ لا يكون في استعمالها مخالفة شرعية، كما فعّلت الشريعة استعمال الوجاهة تفعيلا إيجابيا، فحثّت على استعمالها في الصلح بين الناس، أو في رد الحقوق لأصحابها، وحرّمت استعمالها في الاعتداء على حقوق الآخرين بالمحسوبية والذاتية، أو استعمالها في الغش والخداع والتدليس. This research studies the notability and the controls of its use in Islamic law. The research aims to defining the meaning of notability with an explanation of its foundations, as well as pointing to the role of Islamic Sharia in activating it within social transactions. It also aims to analyze and explain some positive and negative models of notability, and extrapolate the Sharia guidelines for the use of notability in a transaction. Among the most important results of the research is that notability is the social standing whose holder; is trusted and respected by the people. Sharia regulated the use of this standing in social transactions with several conditions, including: that it not used for harm, priority of the public interest over the private interest, and its use not be in violation of the Sharia. As that Sharia activated the use of notability in a positive way, urging for its use in reconciliation between people, or in returning rights to their owners. In addition, prohibited its use in attacking the rights of others by favoritism, or using it in cheating, deception and fraud
