أسس ومقوّمات التشريع الأسريّ في الجزائر

الملخص
يدرس هذا البحث القواعد الأساسية المعتمدة في وضع التشريع الأسري الجزائري، ويهدف إلى بيان المقوّمات الأساسية التي اعتمدها المشرع الجزائري في التشريع الأسري، وتحديد أطر استقراء تلك الأسس والمبادئ من خلال النصوص، وبيان معايير تقسيمها، كما يهدف إلى تقييم قانون الأسرة الجزائري تقييما شرعيا، مع الإشارة إلى أهمية المحافظة على المرجعية الدينية، ودورها في حفظ الثوابت التشريعية، ومن أهم نتائج البحث أنّ مقوّمات التشريع الأسري كثيرة منها اعتماد الشريعة الإسلامية مصدرا أساسيا للأحكام، واعتماد ترتيب العلاقات الأسرية في بعض الأحكام، بالإضافة إلى أنّ دراسة المقوّمات الأساسية للقوانين والتشريعات تدعم العلاقة بين النصوص التشريعية والمعطيات الدينية والعرفية للمجتمع، وتساعد في تفعيل أواصرها، وكلما زادت هاته العلاقة تعمقا زادت أحكام التشريع ثباتا ويقينا وقبولا. This research studies the basic rules adopted in the development of Algerian family legislation. It aims to clarify the foundations adopted by the Algerian legislator in family legislation, and defining the ways of extrapolating these foundations and principles through the articles, and clarifying the criteria for dividing it. It also aims to evaluate the Algerian family law according to Sharia. With reference to the importance of preserving the religious beliefs, and its role in preserving legislative constants. Among the most important results of the research is that the elements of family legislation it many; including the adoption of Sharia as a primary source of rulings. Adopting the arrangement of family relations in some rulings .In addition, study of the basic components of laws and legislation supports the relationship between legislative texts and the religious and customary marbles of society, and help activate it ties. In addition, if this relationship develops, the provisions of legislation will increase stability, certainty and acceptance
