Description

An international, bi-annual, free and peer-reviewed journal published by El Bassira Center for Research, Consulting and Learning Services, Algeria. The journal focuses on publishing research and articles in the field of Islamic sciences, it receives scientific research in the three languages: Arabic, English and French. It aims to: - Publish and encourage the production of researchers and scholars, including professors, researchers and doctoral students, especially research related to the cultural and social environment, regarding to Islamic sciences. – Promote scientific research in Islamic studies and Islamic heritage in general – Encourage intellectual studies, as well as studies in the field of comparative religion to achieve human dialogue and introduce Islam – Encourage jurisprudence, Quranic and hadith studies to serve intellectual issues, especially emerging ones – Encourage research in the fields of social and human sciences. The journal is committed to publish original research that fulfills the required academic conditions, and rejects what violates the ethics of scientific research and scientific integrity.

التَّحقيق في كيفيَّة صلاة القادر على القيَّام خَلْفَ العاجز عنه دراسة فقهيَّة مقارنة Investigating how someone who is able to stand prays behind someone who is unable to stand-A comparative jurisprudential study

الملخص: تقومُ إشكاليَّة هذه الدِّراسة على التَّحقيقِ في مسألةٍ من المسائل الفِقهيَّة الـمُهِمَّة؛ التي اخْتَلَفَ في بيانِ حُكمها العُلماء، وخاضَ غِمارها بعضُ الـمُتفقِّهةُ والدَّهْمَاء، وخَلَّفَت وراءَها سَيْلاً من السِّجالات والآراء، خاصَّة في بعضِ المساجد عندما يُصابُ الإمامُ ببَعْضِ الأدْوَاء، التي تحولُ بَيْنَهُ وبين القِيَّام أو الرُّكوعِ أو السُّجود أو الانحناء؛ ممَّا يقتضي طرح هذا التَّساؤل البَنَّاء:" ما هي كيفيَّة صلاة القادر على القيَّام خَلْفَ العاجز عنه؟ ". فتأتي هذه الوَرَقةُ البَحْثِيَّةُ لدِرَاستِها في رحابِ الفقهِ الإسلاميِّ المقارن؛ والذي يقومُ على سَرْدِ الأقوال وبيان الأدلَّةِ وبتَبْريزِ الـمُدافعاتِ؛ للخُلوصِ إلى القول الرَّاجح في المسألةِ، بحسَبِ ما يُفْضِي إليه الحديثُ والأثر، ويجرُّ إليه جانبُ التَّعليلِ والنَّظر. وتأتي هذه المحاولة ضِمْنَ طَرْحٍ جديد في الدَّعوةِ إلى انصافِ المذاهبِ الفِقهيَّة المتبوعة، والمساهمة في التَّخفيفِ من التَّعصُّبِ لاجتهاداتِ الأشخاصِ وآرائهم، كما تهدفُ هذه الورقات إلى صِناعة العقل الفِقهيّ المعاصر، وتكوين الـمَلَكة الفِقهيَّة الرَّزينة. The problem of this study is based on investigating one of the important jurisprudential issues. The ruling on which scholars differed, and some jurists and demagogues waded into it, and left behind a torrent of debates and opinions, especially in some mosques when the imam was afflicted with some medication, which prevented him from standing, kneeling, prostrating, or bowing; Which necessitates asking this constructive question: “What is the method for a person who is able to stand to pray behind someone who is unable to do so?” This research paper aims to study it within the scope of comparative Islamic jurisprudence. Which is based on narration Statements, presenting evidence, and highlighting defenses; To arrive at the most correct opinion on the issue, according to what the hadith and impact lead to, and the aspect of reasoning and consideration is included in it. This attempt comes within a new proposal in calling for fairness to the followed jurisprudential schools of thought, and contributing to alleviating intolerance to people’s jurisprudence and opinions. These papers also aim to shape the contemporary jurisprudential mind and form the sober jurisprudential faculty.

الملخص: الملخص تهدف هذه الدراسة إلى بيان مفهوم العقود المركبة باعتبارها نمطاً من أنماط التعاقد، ومنتجاً مصرفياً مطوراً لدى المصارف الإسلامية، والإشارة إلى أهم أنواعها ودراسة تفصيلية في مجمل الأسباب الداعية إلى تركيب العقود بوجه عام مع صرف نوع من العناية الخاصة إلى الأسباب المتعلقة بتركيب العقود في المؤسسات المالية الإسلامية بغية تطوير أدوات تمويلية واستثمارية ومنتجات مصرفية تراعي أحكام الشريعة الإسلامية التي تعد مرجعية للمؤسسات المالية الإسلامية في مجمل أنشطتها التمويلية والاستثمارية، وصولا إلى استخلاص أهم النتائج والتوصيات التي تم إيداعها في الخاتمة. Abstract This study aims to explain the concept of complex contracts as a type of contracting and a banking product developed by Islamic banks, and to point out the most important types and a detailed study of the overall reasons for composing contracts in general, while paying special attention to the reasons related to composing contracts in financial institutions. In order to develop financing and investment tools and banking products that take into account the provisions of Islamic Sharia, which is a reference for Islamic financial institutions in all their financing and investment activities, leading to drawing the most important results and recommendations that were deposited in the conclusion.

الملخص: يكشف هذا البحث عن ملامح الاهتمام بنظرية المعرفة أو فقه العلم كما تضمنته مصنفات الحافظ الخطيب البغدادي (463هـ) وما نُقل عنه من الآراء والمواقف والأعمال. يجد المتصفح لدواوين الخطيب المتنوعة والمؤصلة لكثير من المسائل والمباحث الحديثية أنه قد أشار أيضًا إلى كثير من القضايا المعرفية منها تعريف العلم، ومقاصد العلم ومرتبته، وتقسيم العلم إلى ضروري ومكتسب، ومسائل تتعلق بمفاهيم الظاهر والغلبة والظنية، كما اهتم بتحقيق الأصولية في الحقل العلمي وربط المعرفة بوسائلها كالحفظ والتقييد والعمل. ويقترح الباحث ثلاثة أبعاد مهمة تحيط بالمنهج العلمي للخطيب البغدادي وهي: بعد الرواية النقلية، وبعد الدراية العقلية، وبعد الرعاية القلبية. ويسلك الباحث في هذه الدراسة كلا المنهجين الاستقرائي والاستنباطي للوصول إلى التصور الأبستمولوجي لمنهج الخطيب وذلك من خلال استخلاص ملامح ذلك التصور من مصنفاته واستنباط بعض الإشارات من نصوصه. ويرجو الباحث أن يسهم هذا العمل في تحقيق التواصل بين العلوم وتحقيق الرؤية التجديدية في مسار البحث العلمي. This study delves into the epistemological aspects of hadith literature through the works of al-Ḥāfiẓ al-Khaṭīb al-Baghdādī, exploring his discussions on the theory of knowledge. al-Khaṭīb addressed various issues such as the definition and purpose of knowledge, its hierarchy, and classical epistemic categories. The research identifies three methodological dimensions in al-Khaṭīb’s framework: transmission, meaning, and spiritual aspects. Notably, his inclusion of the mutawātir-āḥād division into hadith studies is highlighted as a significant contribution, impacting subsequent scholars like Ibn al-Ṣalāḥ. Employing both inductive and deductive methods, this research aims to bridge religious sciences with modern discourse, fostering a renewed approach to intellectual inquiries.
