أثر مواكبة المبادرات الأجنبية في معالجة النوازل الفقهية والقانونية

الملخص
يدرس هذا البحث دور مواكبة الاجتهادات الأجنبية في ضبط النوازل فقها وقانونا، ويهدف إلى الدعوة إلى الاستفادة من تجارب الغير وتفعيلها في القضايا العارضة، وتفعيل العلاقة بين الواقع المعيش والأحكام الفقهية والقانونية الحاكمة، كما يهدف إلى بيان أهمية مواكبة التشريعات الأجنبية في معالجة الأحداث الداخلية النازلة، وتعداد الأسس الضرورية لهذه المواكبة وضوابطها، ومن أهم نتائج البحث أنّ مواكبة التشريعات تلعب دورا هاما في ضبط ومعالجة النوازل المستجدة، وتساعد على تفادي الأخطاء من خلال الاستفادة من تجارب الغير، ليكون الحكم ناتجا عن تجربة لا عن افتراض، وتتجلى أهمية مواكبة المبادرات الأجنبية في أنها تحقق التفاعل الإيجابي، وتؤسس للتواصل العالمي، وتدعو للاستفادة من الغير، كما أنه لا بدّ أن تنضبط بما يتوافق مع أفكار الـمُواكِب ومبادئه. This research studies the role of keeping pace with foreign jurisprudence in controlling the emerging issues in jurisprudence and law. It aims at calling for benefiting from the experiences of others, and activating them in incidental issues and activating the relationship between the reality and the ruling jurisprudential and legal issued. It also aims to explanation the importance of keeping pace with foreign legislation in dealing with emerging internal events, and determine the necessary foundations for this keeping up and its controls. Among the most important results of the research is that Keeping pace of legislation gives an important role in controlling and dealing with emerging issues, and helps avoid mistakes by benefiting from the experiences of others, so that judgment results from experience not from guess. Keeping pace with foreign initiatives achieves positive interaction, establishes global communication, and calls for benefit from others. In addition, this harmonization must disciplined in accordance with the thoughts and principles of the follower
