مبدأ اليقين القضائي في الأحكام الجنائية

الملخص
يدرسُ هذا البحثُ مبدأ اقتناع القاضي ومدى أهميته في تقرير الأحكام الجزائية، ويهدفُ البحث إلى التعريف بمصطلح اليقين القضائي وبيان مدلوله، وتحديد مدى سلطة القاضي الجنائي في تقدير أدلة الإثبات، كما يهدفُ إلى بيان مدى ارتباط اليقين القضائي بالمبادئ الأساسية في التجريم والعقاب، وبيان أهمية تفعيل هذا المبدأ في تحقيق العدالة في الأحكام الجزائية، ومن أهم النتائج التي توصل إليها البحث أنّ اليقين القضائي هو القناعة التامة التي يصل إليها القاضي بعد تمحيص الأدلة، والإحاطة بظروف القضية، ويبني عليها حكمه بما يُوافق العقل والمنطق، لا الاقتناع الشخصي، كما أنّ تقدير أدلة الإثبات مبني على اقتناع القاضي، ولا رقابة عليه في ذلك إلا ضميره، بشرط أن يكون حكمه مُعَلّلا تعليلا كافيا، ولا تتحقق الإدانة إلا بالدليل اليقيني القاطع الذي يقتنع به القاضي، فإن ثار عنده شك في الأدلة رجع إلى البراءة؛ لأنها الأصل. This research studies the principle of the judge’s conviction and its importance in deciding the criminal Judgments. The research aims to define the term judicial certainty and clarify its meaning, and determine the authority of the criminal judge in evaluating the evidence. It also aims to statement of the link between judicial certainty and basic principles of criminalization and punishment. As well, highlight the importance of activating this principle in achieving justice in criminal judgments. One of the most important results of the research is that judicial certainty is the complete conviction that the judge reaches after examining the evidence, basing his judgment on them in a manner that agrees with reason and logic, not personal conviction. As well, the discretion of the evidence based on the conviction of the judge, and there is no control over him in that except his conscience, Provided that it his judgment is sufficiently justified. The condemnation is only be achieved with the conclusive evidence that convince the judge. If he has doubts about the evidence, he returns to the innocence, because it is the original
