الملخص
نص المؤسس الدستوري في التعديل الدستوري لسنة 2020 على تشكيلة المجلس الاعلى للقضاء خلافا للتعديلات الدستورية السابقة التي كانت تحيل للقانون مسألة تحديد تشكيلة المجلس الاعلى للقضاء حيث كان المؤسس الدستوري يكتفي بالنص على إسناد رئاسة المجلس الاعلى للقضاء لرئيس الجمهورية في الحالات العادية وإسنادها للرئيس الاول للمحكمة العليا في الحالة التأديبية. كما تضمن التعديل الدستوري الأخير تدعيم صلاحيات المجلس الاعلى للقضاء سعيا من المؤسس الدستوري إلى تكريس المزيد من الضمانات التي تضمن استقلالية القاضي والسلطة القضائية حيث يمارس المجلس الاعلى للقضاء العديد من الصلاحيات التي تتعلق بتنظيم المسار المهني للقاضي بدأ بتعيينه ونقله وترقيته والوضعيات القانونية وإنهاء مهامه بالطرق العادية أو عن طريق التسريح أو العزل، كما يعتبر المجلس الاعلى للقضاء جهة استشارية لرئيس الجمهورية في العديد من الصلاحيات التي يمارسها رئيس الجمهورية ضمن السلطة القضائية، إذ تتنوع الاستشارة بين الرأي الملزم والرأي غير الملزم لرئيس الجمهورية. In the constitutional amendment of the year 2020, the constitutional founder stipulated the formation of the Supreme Judicial Council, in contrast to previous constitutional amendments that referred to the law the issue of determining the composition of the Supreme Judicial Council, as the constitutional founder was satisfied with stipulating that the presidency of the Supreme Judicial Council be entrusted to the President of the Republic in ordinary cases and assigning it to the first president of the Supreme Court in Disciplinary status. The recent constitutional amendment also included strengthening the powers of the Supreme Judicial Council in an effort by the constitutional founder to devote more guarantees that guarantee the independence of the judge and the judicial authority, as the Supreme Judicial Council exercises many powers related to organizing the professional path of the judge, starting with his appointment, transfer and promotion, legal situations, and the termination of his duties by regular means or Through dismissal or dismissal, the Supreme Judicial Council is an advisory body to the President of the Republic in many of the powers that the President of the Republic exercises within the judicial authority, as advice varies between binding opinion and non-binding opinion of the President of the Republic.
