دور تدابير الضبط الإداري في الحد من انتشار وباء فيروس كورونا (كوفيد - 19) The Role Of Administrative Control Measures In Reducing The Outbreak Of The Corona Virus (covid 19)

الملخص
نظرا لانتشار وباء فيروس كورونا لجأت السلطات العمومية المختصة لاتخاذ جملة من التدابير الوقائية للحد من انتشاره ومكافحته، إذ تتنوع هذه التدابير بين تقييد بعض الحريات ولاسيما حرية التنقل والتجمع والحرية الاقتصادية وتنظيم المرافق العامة بغرض التكيف مع الوضع والحد من انتشار الوباء. وتتمثل أهم التدابير التي تتخذها السلطات المختصة بالضبط الإداري في الغلق لبعض الأنشطة التجارية، تعطيل وسائل النقل، منح العطل الاستثنائية للمستخدمين، الحجر المنزلي، التباعد الامني الملزم، مع إتباع هذه التدابير وغيرها بعقوبات إدارية وجزائية حتى يتم احترامها. تهدف هذه الدراسة إلى التطرق للتدابير المتخذة في الجزائر للحد من انتشار وباء فيروس كورونا (كوفيد -19)، وذلك من خلال تحليلنا للنصوص القانونية والتنظيمية المتضمنة للتدابير، واستنتاجنا للنقاط الايجابية والنقائص إن وجدت، وإثرائنا لهذه الدراسة بنتائج تساهم في الحد من انتشار الوباء. In view of the spread of the Corona virus, the competent public authorities have resorted to taking a number of preventive measures to limit its spread and combat it, as these measures vary between restricting some freedoms, especially freedom of movement and assembly, economic freedom, and organizing public facilities in order to adapt to the situation and limit the spread of the epidemic. The most important measures that the competent authorities take precisely in the administration are to close some commercial activities, disrupting transportation, granting exceptional holidays to users, home quarantine, binding security spacing, and following these and other measures with administrative and penal penalties until they are respected. This study aims to address the measures taken in Algeria to reduce the spread of the Corona virus (Covid-19), through our analysis of legal and regulatory texts that include the measures, our conclusion of positive points and shortcomings if any, and our enrichment of this study with results that contribute to reducing the spread of the epidemic.
