Evidence Approaches To Medical Errors In View Of Islamic Perspective; (a Descriptive Analytical Study)

الملخص
The study aimed at exploring the nature of medical errors and means of evidence of according to the Islamic Law. The study used the descriptive analytic methodology to reach the targets in question. To gather the required data, a review of literature was administered. The study came to the conclusions; first, the medical error is considered a chastening crime according to Islam, second; the evidence of medical error is unrestricted according to the most supported opinion in the Islamic jurisprudence; third, the most important means of evidence of medical error according to the Islamic jurisprudence are witness, confession, medical documents and opinion of experts . The study recommended that the law proposal it suggests for evidencing the medical error in view of Islam teachings ought to be put into effect. استهدفت الدراسة الحالية بيان طبيعة الخطأ الطبي، ووسائل إثباته وفقا للشريعة الإسلامية. واعتمدت الدراسة على المنهج الوصفي. واستندت – في إطار ذلك – إلى الأسلوب التحليلي. وتمثلت أداة الدراسة فى مسح الأدبيات المتعلقة بموضوع الدراسة. وأسفرت الدراسة عن العديد من النتائج أبرزها: يعد الخطأ الطبي في تكييفه الشرعي جريمة تعزيرية - لا يتقيد إثبات الخطأ الطبي بوسائل معينة على الراجح في الفقه الإسلامي – يثبت الخطأ الطبي يثبت في الشريعة الإسلامية بوسائل إثبات عديدة أهمها: الشهادة، والإقرار، والكتابة، والخبرة. وأوصت الدراسة الحالية بتبني مشروعها القانوني المفترح لإثبات الخطأ الطبي وفقا لما تقره، وتوجبه الشريعة الإسلامية.
