الملخص

أصبح الأمن القانوني من أهم مبادئ دولة القانون، وهو مقياس فعالية أي نظام قانوني، خاصة ما يتعلق باستقرار القاعدة القانونية وسهولة الوصول إليها وتوقعها، لأنه يرمي إلى حماية الأفراد من القانون في بعض جوانبه السلبية ومنها ظاهرة التضخم التشريعي الذي يحصل بموجبه نوع من عدم الانسجام بين القواعد القانونية وكذا عدم وضوح صياغتها. فالأمن القانوني يرمي إلى تحقيق وإشاعة الثقة لدى الأفراد وعدم حصول المفاجأة بتصرفات من السلطة العامة. وعليه يقوم الأمن القانوني على مقومات وتهدده عوائق وتحصل حمايته بآليات قانونية. Legal security has become one of the most important principles of the rule of law, and it is a measure of the effectiveness of any legal system, especially with regard to the stability of the legal base, accessibility and predictability, because it aims to protect individuals from the law in some of its negative aspects and the phenomenon of legislative inflation, according to which a kind of inconsistency occurs between the rules As well as the lack of clarity of its wording. Legal security aims to investigate. Legal security aims to achieve and spread confidence among individuals and not to be surprised by the actions of the public authority.
