حُكم طلاق الهازل في الفقه الإسلاميِّ دراسة فقهيَّة مقارنة

الملخص
تبحثُ هذه الورقات؛ مسألة من المسائل الفِقهيَّة المهِمَّة، التي أثارت العديدَ من التَّساؤلات، ودارَت حَوْلَها جملةٌ من المناقشات، خاصَّة في هذه الأوقات؛ وهي:" حُكم طلاق الهازل ". فجاءت هذه الدِّراسة لتُبَيِّنَ أقوال الفُقهاء في القديمِ والحديثِ فيها، وتُجلِّيَ أبرز الأدلَّة النَّقليَّة والعقليَّة التي عَوَّلَ كلُّ فريقٍ منهم عليها، وتَزْبُر قائمة الاعتراضات وسِلْسِلَة المدافعات التي كانت بينهم؛ للخُروجِ بالرَّأي المختار في المسألة، بحسَبِ ما يُوصلُ إليه صحيحُ المنقول، ويمليه صريحُ المعقول. وتأتي هذه الدِّراسة المقارنة ضِمن الدَّعوة الجادَّة إلى انصاف المذاهب الفِقهيَّة المتبوعة، والمساهمة الفعَّالة في التَّخفيف من التَّعصُّب المذموم لاجتهادات الأشخاص وتقديس آرائهم، كما تَتَغَيَّا هذه السُّطورُ صِناعة العقل الفِقهيّ المعاصر، وتكوين الملكة الفِقهيَّة الرَّزينة التي لا تَتَحَقَّقُ إلَّا من خِلال استشرافِ أقوال الأئمَّةِ الأكابر، وإشباع النَّظر بنُصُوصِهم، وطريقة فَهْمِهم للأدلَّةِ القائِمَة على القواعد والأصول. These papers examine; An important jurisprudential issue that raised many questions, and a number of discussions took place around it, especially in these times. It is: “The ruling on divorce.” This study came to clarify the sayings of ancient and modern jurists regarding it, and to clarify the most prominent transmissional and rational evidence that each of them relied on, and to provide a list of objections and a series of defenses with which each group responded to the other, in order to arrive at the most correct opinion on the issue, according to what the hadith and its impact lead to. , It is dictated by the aspect of reasoning and consideration. This attempt comes within a new proposition, a sure endeavor, with a happy approach. In calling for fairness to the followed jurisprudential schools of thought, and contributing effectively to alleviating the reprehensible intolerance of people’s opinions and sanctifying their opinions, these lines also address the crafting of the contemporary jurisprudential mind, and the formation of the sober jurisprudential faculty that can only be achieved by anticipating the sayings of the great Imams, and Satisfying one's eyes with their texts and their way of understanding For evidence based on rules and principles.
