التَّحقيق في مسألة الصَّلاة على الجِنازة في المسجد دراسة فقهيَّة مُقارنة

الملخص
تبحثُ هذه الورقات؛ مسألة من المسائل الفِقهيَّة، التي أثارت العديدَ من التَّساؤلات، ودارَت حَوْلَها جملةٌ من المناقشات، خاصَّة في هذه الأوقات؛ وهي:" حُكم الصَّلاة على الجِنازة في المسجد ". فجاءت هذه الدِّراسة لتُبَيِّنَ أقوال الفُقهاء في القديم والحديث فيها، وتُجلِّيَ أبرز الأدلَّة النَّقليَّة والعقليَّة التي عَوَّلَ كلُّ فريقٍ منهم عليها، وتَزْبُر قائمة الاعتراضات وسِلْسِلَة المدافعات التي رَدَّ بها كلُّ فريقٍ على الآخر، للخُلوصِ إلى القول الرَّاجحِ في المسألة، بحسَبِ ما يُفضي إليه الحديثُ والأثر، ويمليه جانبُ التَّعليل والنَّظر. وتتنزَّل هذه المحاولة ضمن طَرْحٍ جديد، وسَعْي أكيد، بمنهج سَعيد؛ في الدَّعوة إلى انصاف المذاهب الفِقهيَّة المتبوعة، والمساهمة الفعَّالة في التَّخفيف من التَّعصُّب المذموم لاجتهادات الأشخاص وتقديس آرائهم، كما تَتَغَيَّا هذه السُّطورُ صِناعة العقل الفِقهيّ المعاصر، وتكوين الملكة الفِقهيَّة الرَّزينة التي لا تَتَحَقَّقُ إلَّا من خِلال استشرافِ أقوال الأئمَّةِ الأكابر، وإشباع النَّظر بنُصُوصِهم، وطريقة فَهْمِهم للأدلَّةِ القائِمَة على القواعد والأصول. These papers are looking; An important jurisprudential issue, which raised many questions, and a number of discussions took place around it, especially in these times; It is: “The ruling on performing the funeral prayer in the mosque.” This study came to show the sayings of the jurists in the old and the new, and to clarify the most prominent textual and mental evidence that each of them relied on, and to examine the list of objections and the series of defenses with which each team responded to the other, in order to reach the most correct opinion in the matter, according to what is said. The hadeeth and the effect were given to him. It is dictated by reasoning and consideration. This attempt is revealed within a new proposition, and a sure quest, with a happy approach. In the call for fairness to the followed jurisprudential schools, and the effective contribution to alleviating the reprehensible fanaticism of people’s jurisprudence and the sanctification of their opinions, as these lines seek to craft the contemporary jurisprudential mind, and to form the jurisprudential faculty that can only be achieved through anticipating the sayings of the imams.
