التَّحقيق في مسألة سفر المرأة إلى حَجِّ الفريضة بلا مَحْرَم دراسة فقهيَّة مقارنة

الملخص
ملخص: تأتي هذه الورقات لدِراسَة مَسألة من المسائل الفِقهيَّة الـمُهِمَّة، التي اختلفَ في بيان حُكمِها الفُقهاء الأعلام، وخاضَ غِمارَها بعضُ الدَّهْمَاء والعوام، وأثارت جدالاً واسِعًا هذه الأيام؛ وهي مَسألة:" حكم سَفَر المرأة إلى حَجِّ الفريضة بلا مَحْرَم ". فجاءت هذه الدِّراسَةُ لتُبَيِّنَ أقوال العُلماء في القديم والحديث فيها، وتجلِّي أبرز الأدلَّة النَّقليَّة والعقليَّة التي اسْتَنَدوا إليها، ثمَّ عُنِيَ البحثُ بمناقشة هاذيك الأدلَّة مُناقشةً عِلميَّة للخُلوصِ إلى القول الرَّاجِح في المسألة؛ وذلك بحسَبِ ما يجرُّ إليه الحديثُ والأثر، ويفضي إليه جانِبُ التَّعليل والنَّظر. وتتَنَزَّلُ هذه المحاولة ضِمْنَ طَرْحٍ جديد وسَعْي أكيد بمنهج سَعيدٍ في الدَّعوةِ إلى انصافِ المذاهبِ الفِقهيَّة المتبوعة، والمساهمة في التَّخفيفِ من التَّعصُّبِ المذمومِ لاجتهاداتِ الأشخاصِ وآرائهم، كما تهدفُ هذه الورقات إلى صِناعة العقل الفِقهيّ المعاصر، وتكوين الـمَلَكة الفِقهيَّة التي لا تَتَحَقَّقُ إلاَّ من خِلال استشراف أقوال الأيمَّة الفحول. These papers come to study one of the important jurisprudential issues, which the prominent jurists differed in explaining its ruling, and some of the demagogues and the common people fought in it, and it sparked a wide controversy these days; It is an issue: “The ruling on a woman traveling for the obligatory Hajj without a mahram.” This study came to clarify the sayings of scholars in the past and the hadith in them, and to clarify the most prominent textual and mental evidence on which they relied. This is according to what is drawn to the hadith and the effect, and the side of reasoning and consideration leads to it. This attempt comes within the framework of a new proposition and a sure quest with a happy approach in calling for fairness to the followed jurisprudential schools, and contributing to alleviating the reprehensible intolerance of people's jurisprudence and opinions. A coffee that can only be achieved through anticipating the sayings of the imams stallions.
