آليات تسوية البنايات المنجزة خلافا لرخصة البناء المسلّمة تطبيقا للمرسوم التنفيذي رقم 22-55

الملخص
نص المرسوم التنفيذي رقم 22-55 على جملة من الشروط والإجراءات لتسوية وضعية البنايات المكتملة أو في طور الانجاز المنجزة خلافا لأحكام رخصة البناء المسلّمة، وذلك بتسليم المعني رخصة بناء معدّلة، أو شهادة مطابقة إذا كان البناء مكتملا، بعد دراسة الملف من طرف لجنة مختصة ومعاينة البناء، مع دفع المخالف غرامة مالية تحدد حسب قيمة البناية المعنية، وأما إذا كان بناء المعني غير قابل للتسوية لعدم استجابته لمقاييس ومعايير البناء فمآله الهدم طبقا للقانون. يمكن للمعني الطعن في قرار رفض التسوية أمام لجنة الولاية، وفي حالة الرفض أو عدم الرد في الآجال المحددة يمكنه الطعن لدى الوزارة المكلفة بالعمران، وله بعد ذلك حق رفع دعوى قضائية أمام القضاء المختص لطلب إلغاء قرار الرفض. Abstract: Exécutive Decree 22-55 stipulated a set of conditions and procédures for setting the status of completed or under construction completed buildings, contrary to the provisions of the delivered building permit, by handing over to the concerned a modified building permit , or a confermity certificate if the building was complete , after studying the file by a specialized committee and inspecting the building, with payment of the violator is a fine that is determined according to the value of the building in question. But if the building concerne dis not capable of settlment because it does not comply with the building standarts and standarts, the i twill be demolished according to the laww. The person conserned can appeal the decision to reject the settement before the state committee, and in the event of rejection or failure to respond within the specified deadlines , he can appeal to the ministry , in charge of urbanization, and he has the right to file a lawwsuit before the completent judiciary to request the cancellation of the rejection decision.
