النظام القانوني لرخصة البناء في ضوء المرسوم التنفيذي رقم 15/19

الملخص
تُعدّ رخصة البناء أحد أهمّ القرارات الفردية في المجال العمراني، إذ تهدف إلى التّوفيق بين ممارسة الأفراد حقّ البناء في إطار حماية البيئة ومتطلبات المصلحة العامّة العمرانيّة. وبذلك كانت رخصة البناء الضّمان الأساسي لاحترام مقتضيات النظام العام العمراني. وهو ما نلمسه من خلال العناية الّتي أولاها لها المشرّع في المرسوم التّنفيذي رقم15/19 المحدّد لكيفيات تحضير عقود التعمير وتسليمها. Abstract: The Building license considered as one of the most important individual decisions in the urban field, It aims to reconcile between the practice of individuals of the right to build within the framework of the environment protection and the requirements of the urban public interest. Thus, the building license was the basic guarantee for respecting the dispositions of the urban public order. This is what we see through the care given to it by the legislator in the executive decree No. 15/19, fixing the modalities of preparation and delivery of construction contracts.
