نهاية عقد الوكالة المحفزة في ظل المرسوم رقم 18-199 المتعلق بتفويضات المرفق العام

الملخص
تنتهي عقود تفويضات المرفق العام عامة وعقد الوكالة المحفزة خاصة إما نهاية طبيعية،بتنفيذ مضمون العقد "التفويض"أو بإنتهاء المدة المتفق عليها أوالمحددة قانونا أو تنظيما مما يؤدي الى زوال الرابطة العقدية، أو عن طرق نهاية غير طبيعية "مبسترة" بتدخل طرفي العقد، بناءا على إتفاق رضائي بين المتعاقدين أو من جانب منفرد للإدارة بما تملكه من سلطات يمنحها إياها البند غير المألوف كونها سلطة عامة. Abstract: The end of the incentive agency contract under Decree No. 18-199 related to public utility delegations Public utility authorization contracts generally terminate and the incentive agency contract in particular, either by a natural end, by implementing the content of the “ authorization “ contract or by the end of the period agreed or legally defined or organized which leads to the demise of the contractual association, or by an “unpasteurized” abnormal end with the intervention of both parties to the contract, Based on a consensual agreement between the contractors or by the administration alone, with the powers it possesses, conferring on it the uncommon clause being a public authority.
