دراسة تحليلية لإختصاص القضاء الإداري الجزائري بالفصل في منازعات رخص التعمير

الملخص
يعد موضوع منازعات التعمير من المواضيع الشائكة التي تواجه الإدارة، ذلك أنها تمثل تصادم مصلحتين مختلفتين، الأولى مصلحة خاصة بالملاك و الأفراد أصحاب الحقوق " حق الملكية " الذين يرغبون في ممارسة حقهم في الملكية، و الثانية مصلحة عامة أخذت بعين الاعتبار حماية المجتمع و فرض إجراءات الضبط في مجال التعمير، وعليه فإن هذه الدراسة تهدف إلى تحديد معالم المنازعات المثارة في الجانب العمراني إضافة إلى بناء بحث علمي متكامل يشمل جميع رخص التعمير و المنازعات الناشئة عنه. وقد توصلنا في خضم هذه الورقة البحثية إلى جملة نتائج أهمها عدم تقيد الإدارة بالنصوص القانونية في مجال رخص التعمير، إلى جانب فشل المساعي الودية لفض النزاع في مجال رخص التعمير بدليل الكم الهائل للقضايا المطروحة أمام العدالة في هذا الموضوع. Abstract: The issue of construction disputes is one of the thorny issues facing the administration, as it represents the clash of two different interests, the first is a private interest for owners and individuals with rights “the right of ownership” who wish to exercise their right to property, and the second is a public interest that takes into account the protection of society and the imposition of measures Control in the field of construction, and therefore this study aims to identify the features of the disputes raised in the urban aspect in addition to building an integrated scientific research that includes all construction licenses and disputes arising from it. In the midst of this research paper, we reached a number of results, the most important of which is the administration’s lack of compliance with legal texts in the field of construction licenses, in addition to the failure of friendly efforts to resolve the dispute in the field of construction licenses, as evidenced by the huge number of cases before justice in this matter.
