منازعات الملكية المشتركة_دراسة تحليلية على ضوء التشريع الجزائري

الملخص
قد وضع المشرع آليات قانونية لضمان حسن إدارة الملكية المشتركة و المحافظة عليها و حسن إنتفاع الشركاء بالملك ، فأحدث بذلك جمعية تتشكل من جماعة الشركاء تتولى إدارة الملكية المشتركة ، و لها صلاحيات في تسيير الأجزاء المشتركة ، كما أحدث المشرع هيئة أخرى للإدارة و التسيير تتمثل في المتصرف الذي يكلف من قبل الجمعية العامة و يعمل على تنفيذ قراراتها. وأما عن أهداف هذه الورقة البحثية فهي تتلخص في معرفة كيفية تطبيق الآليات القانونية لإدارة وتسيير الملكية و حمايتها في الواقع العملي، وكذا إيجاد الحلول الملائمة للإشكالات التي قد تثور في الواقع والنزاعات المطروحة أمام القضاء، وذلك بإعطاء التكييف السليم من خلال إسقاط النصوص المناسبة على هذا الإشكال أو النزاع، أما عن أهم النتائج المتوصل إليها فلعل أهمها أنه على الرغم من أن القانون خول لهيئات الملكية المشتركة الحق في التقاضي من أجل حماية الملك و الملاك إلا أنه في الواقع العملي نادرا إن لم نقل شبه المعدوم ما تقوم الجمعية برفع هذه الدعاوى القضائية.
