شرط ارتباط الفعل الضار بعمل التابع لتحقق مسؤولية المتبوع

الملخص
ملخص: إن قيام مسؤولية المتبوع عن الضرر الذي يحدثه التابع بالغير يتوقف أساسًا على علاقة هذا الفعل الضار بالعمل الموكول إلى التابع، أي أن يكون قد وقع أثناء تأدية العمل أو بسببه أو بمناسبته، ورغم أن التعديل الأخير للتقنين المدني الجزائري قد ذكر هذه الحالات الثلاث التي يسأل فيها المتبوع، إلا أن تحديد مضمونها لم يكن بالأمر اليسير؛ فلم يستقر القضاء على معيار واحد أو معايير محدّدة، وكان هناك تباين شديد في هذا الشأن قديمًا وحديثًا، لا سيما في القضاء الفرنسي، كما لم يتفق الفقه حول ذلك، لكن التوجه العام الآن يسير نحو التوسّع في تقرير مسؤولية المتبوع كلما كان هناك أدنى ارتباط بين الفعل الضار وبين الوظيفة، حماية للمضرور، بل قد تقوم مسؤولية المتبوع في بعض الأحوال حتى في حال عدم وجود ارتباط مع الوظيفة. Abstract: The liability of the contributor for harm caused by the dependant depends primarily on the relationship of the act to the subordinate. Whether it occurred during the course of the work, on the basis of the act or on the occasion of the act, Although the recent amendment to Algerian civil codification mentioned these three cases in which the donor was asked, the content of the latter was not easily determined; the elimination of one criterion or specific criteria had not been established, and there had been a great difference in this regard in the past and recent years, particularly in the French judiciary, the doctrine also did not agree, but the general trend now is toward expanding the determination of liability of the donor whenever there is a minimum link between the harmful act and the job, protecting the wrongdoing, and in some cases even if there is no association with the job..
