تحديد اختصاص رئيس الجمهورية في سلطة التشريع في الجزائر .

الملخص
يمارس رئيس الجمهورية كامل صلاحياته المنصوص عليها في الدستور ، و نابعة من إرادة الشعب الذي صوت لصالحه ، و لا يمكن بأي حال من الأحوال الاعتداء على إرادة الشعب أو المساس بصلاحياته أو تجاوز الصلاحيات من قبله . فقد منح للقاضي الأول في البلاد صلاحية وضع التشريع إلى جانب السلطة التشريعية، و هذه الصلاحيات تتمثل في عرض مشروع دستور أو مشروع قانون أو إصدار أمر أو المصادقة على القانون بعد الموافقة عليه من قبل البرلمان أو نشر التشريع . يهدف البحث إلى بيان إختصاصات رئيس الجمهورية في ظل الدستور سنة 2020 بعد التحولات الجديدة التي عرفتها الجزائر في السنوات الأخيرة ، مع إعتماد المنهج الوصفي و تحليل النصوص بما تتماشى مع سياسة الدولة لمواكبة التطورات الحاصلة و نصل إلى نتائج تتمثل في إرساء دولة الحق و القانون و دولة المؤسسات و الديمقراطية . و نصل إلى توصيات أن السيادة ملك للشعب و لا تعدي عن إرادة الشعب و إحترام خيار الشعب في إختيار رئيس الجمهورية الذي يصل إلى الحكم عبر إنتخابات تعددية و نظيفة و شفافة ، كما انه يجب أن يعبر القانون عن تطلعات الشعب . The President of the Republic exercises all his powers stipulated in the Constitution, stemming from the will of the people who voted for him, and in no way can the will of the people be violated, their powers compromised, or their powers overridden by them , It is not possible in any way to attack the will of the people or prejudice their powers or exceed their powers.. He granted the first judge in the country the power to develop legislation alongside the legislative authority, and these powers are represented in presenting a draft constitution or draft law, issuing an order, ratifying the law after its approval by Parliament, or publishing legislation. The research aims to clarify the competencies of the President of the Republic under the constitution in 2020 after the new transformations that Algeria has known in recent years, with the adoption of the descriptive approach and the analysis of texts in line with the state's policy to keep pace with the developments taking place, and we reach results represented in the establishment of the state of right and law and the state Institutions and democracy. And we reach recommendations that sovereignty belongs to the people and does not transgress the will of the people and respect for the people’s choice in choosing the President of the Republic who comes to power through pluralistic, clean and transparent elections, and that the law must express the aspirations of the people.
