المسألة الدستورية الأولية والمجلس الدستوري الفرنسي

الملخص
الدفع بعدم الدستورية، الذي سماه المشرع العضوي الفرنسي بالمسألة الدستورية الأولية أو المسألة الدستورية ذات الأولوية ( Q.P.C)، سيقوي من الطبيعة القضائية للمجلس الدستوري الفرنسي، لكنه لن يحوله إلى محكمة دستورية بسبب بعض الإكراهات التاريخية للنظام القانوني الفرنسي. رغم إلحاح الفقه الدستوري الفرنسي على المؤسس الدستوري لتسميته بالمحكمة الدستورية، ورغم تغير الإجراءات أمام المجلس الدستوري بمناسبة المسألة الدستورية ذات الأولوية، فالمجلس الدستوري الفرنسي بقى هيئة دستورية سياسية، ذات اختصاص قضائي. وستسلط هذه الورقة البحثية الضوء على تأثير المسألة الدستورية الأولية على طبيعة المجلس الدستوري الفرنسي. The exception unconstitutionality, which the French organic legislator has called the constitutional issue a priority, will strengthen the judicial nature of the French Constitutional Council but will not turn it into a constitutional court due to some historical constraints of the French legal system Despite the insistence of the French constitutional doctrine on the constitutional founder to be named the Constitutional Court and despite the change of procedures before the Constitutional Council on the occasion of the constitutional issue priority, the Constitutional Council remains a constitutional institution of political with jurisdiction. This paper will shed light on the influence of the priority preliminary ruling on constitutionality on the French Constitutional Council.
