تفويض تسيير المرفق العام للهيئات الخاصة بموجب نص تنظيمي

الملخص
عرف تسيير المرافق العامة الإدارية تطورا وانفتاحا على القطاع الخاص، وأصبح من الممكن أن يعهد بتسييرها إلى أشخاص عامة أو خاصة، عن طريق آلية التفويض بموجب نص تنظيمي، والذي يأخذ شكل ترخيص أو اعتماد. هذا التفويض يصدر وفقا لشروط وإجراءات نظمها المشرع بموجب نصوص صارمة ومعقدة تخضع في مجملها للسلطة التقديرية للإدارة، لضبط ممارسة النشاطات المعهود بها للمفوض له وبسط رقابة الإدارة المفوضة عليها، والذي تترتب عنه جملة من الآثار القانونية بالنسبة لأطرافه وللغير، نتج عنها قلة الفعالية المطلوبة. The management of administrative public facilities has witnessed development and openness to the private sector, and it has become possible to entrust its management to public or private bodies through the delegation mechanism under a regulatory text, which takes the form of a license or accreditation. This delegation is issued in accordance with the conditions and procedures organized by the legislator according to strict and complex provisions, that are subject to the discretionary power of the administration, to control the practice of the activities entrusted to the body in charge and to extend the supervision of the responsible authority over them, which entails a number of legal effects for its parties and for others, resulting in a decrease in the required high.
