اجتماعية القاعدة القانونية وأثرها على جودة التشريع

الملخص
يتطلب تحسين النظام القانوني في الدولة وجود صياغة قانونية جيدة، ترتكز على الشكل والمضمون، بهدف معالجة ظواهر سلوكية، انطلاقا من فهم إرادة المشرع وغايته من اقتراح مشروع القانون، أين يقع على عاتق المختصين التعمق في دراسة الظواهر السلوكية الناشئة عن علاقات أفراد المجتمع التي تحتاج إلى تنظيم حفاظا على الحقوق والالتزامات الناشئة بين أفراده، معتمدين في ذلك على معطيات طبيعية وتاريخية كمعطيات رئيسية تبني بها الأفكار التي تشكل المادة الأولية، مع استخدام معطيات عقلية ومثالية مكملة لسابقاتها، وفق قواعد وضوابط ضرورية. يباشر الصائغ ترجمة الأفكار، بعبارات وجمل واضحة ودقيقة وقابلة للتطبيق، سهلة الفهم من عامة الناس، حائزة على رضى المخاطبين بها، وتترتب أثار نسبية عن اجتماعية القواعد القانونية، تقاس حسب درجة وضوح واستقرار التشريع الناتج عنها. Improving the legal system in the country requires a good legal formulation, based on form and content, with the aim of addressing behavioral phenomena, based on an understanding of the will of the legislator and its purpose in proposing the draft law. An organization in order to preserve the rights and obligations arising among its members, relying on natural and historical data as main data by which to build the ideas that constitute the raw material, with the use of rational and ideal data complementing its predecessors, according to necessary rules and controls. The goldsmith proceeds with translating ideas, in clear, accurate and applicable phrases and sentences, easy to understand by the general public, obtaining the approval of the addressees, and the relative effects of social legal rules, measured according to the degree of clarity and stability of the resulting legislation.
