الملخص
ملخص: إن الفضل في نشأة التجارة الالكترونية يعود للثورة المعلوماتية التي عرفتها البشرية مع نهاية القرن العشرين وبداية القرن الواحد والعشرين وكذا التطور الحاصل في تكنولوجيا المعلومات و الاتصالات الالكترونية لا سيما الشبكة المعلوماتية العالمية(الانترنت)، وفي ظل هذا التطور نشأت التجارة الالكترونية واستفادت من هذه الامكانيات الجديدة ، والتي أثرت على الطريقة التي تتم بها ممارسة المعاملات التجارية والاقتصادية بصفة عامة . تهدف هذه الدراسة إلى بيان أهمية الحماية الجنائية لمواقع التجارة الإلكترونية والبيانات الشخصية للمستهلكين من الإعتداء عليها لزرع ثقة المتعاملين في التجارة الالكترونية ، إذ لا تكفي الحماية المدنية لوحدها ، وبما أن مفهوم التجارة الالكترونية قانونيا لا يختلف عن مفهوم التجارة التقليدية من حيث الاعلان عن السلع والمنتجات وعملية التسويق تتم عبر المواقع التجارية الالكترونية بواسطة المورد الالكتروني عبر الانترنت Summary The credit for the emergence of e-commerce is due to the information revolution known by mankind at the end of the 20th century and the beginning of the 21st century, as well as the development of information technology and electronic communications, especially the World Information Network (Internet), and in the light of this development e-commerce originated and benefited from these new possibilities, which affected the way in which commercial and economic transactions are conducted in general. This study aims to show the importance of criminal protection of e- commerce sites and personal data to consumers from being attacked to instil the confidence of customers in e-commerce, as civil protection alone is not enough and since the concept of e-commerce is not different from the concept of traditional trade in terms of advertising of goods and products and the marketing process is carried out through electronic commercial website by electronic supplier via the internet.
