الملخص
تهدف الدراسة إلى تسليط الضوء على تأثيرات الوضعية الاقتصادية في ظل جائحة كوفيد 19 على عقود العمل التي كان لها الأثر البليغ و الواضح على أركانه و مصداقية وجوده ،وقد تجلى ذلك في وضع حتمية نسبية تمثلت في الخروج عن القواعد العامة التي تنظم العلاقات التعاقدية بين العمال والمستخدمين، إذ لجأت بعض المؤسسات إلى تسريح العمال في ظل ما خلفته التدابير الوقائية التي عمدت إليها السلطات ضمانا لحماية النظام العام الصحي ليتضح أن تداعيات جائحة كورونا في ظل إمكانية تكييف وقائعها من حالات القوة القاهرة التي خلفت استحالة مطلقة لتنفيذ مضامين عقد العمل في جوانبه القانونية، أدى بالهيئات المستخدمة إلى اللجوء لعملية تسريح عدد من العمال تحت الدواعي الاقتصادية ضمانا لاستمراريتها وتفاديا لإفلاسها، ما صاحب تسجيل قصور وعجز المنظومة القانونية السارية المفعول في مجال إنهاء علاقات العمل لظروف اقتصادية على الاستجابة لمخلفات جائحة كورونا على عقد العمل. The study aims to highlight the effects of the economic situation under the Covid 19 pandemic on employment contracts that have had a significant and clear impact on its pillars and the credibility of its existence , as demonstrated by the relative imperative of breaking the general rules governing contractual relations between workers and employees, as some institutions resorted to layoffs under the preventive measures adopted by the authorities to ensure the protection of the health public order. It is clear that the repercussions of the CORONA pandemic, given the possibility of adapting its facts from the cases of force majeure, which left it absolutely impossible to implement the contents of the employment contract in its legal aspects , led the bodies used to resort to the process of laying off a number of workers under economic reasons to ensure their continuity and to avoid bankruptcy, which accompanied the registration of the shortcomings and inability of the legal system in force in the area of termination of labour relations for economic circumstances to respond to the remnants of the Corona pandemic on the employment contract.
