تأثير فيروس كورونا على عقود الاستثمار الأجنبي

الملخص
من خلال هذه الدراسة سنتطرق إلى تبيان مدئ تأثير فيروس كورونا على عقود الاستثمار الأجنبية، هذا الفيروس الذي أثر بشكل كبير على حياة المواطنين بصفة عامة وعلى الاقتصاد الدولي والوطني، كما أن الدولة تلجأ لتنفيذ سياستها الاقتصادية إلى تنبني الاستثمار الأجنبي سواء كان مباشرا أو غير مباشر، ويكون ذلك من خلال التعاقد مع مستثمرين أجانب، ويضمن عقد الاستثمار جملة من الالتزامات والحقوق المتبادلة بينهما، غير أنه عند تنفيذ هذا العقد قد تطرأ ظروف خارجة عن نطاق الأطراف قد تعيق تنفيذه، وهذه الظروف وفقا للقواعد العامة ما هي إلا ظرف طارئ، أو قوة قاهرة، قد تجعل الالتزام مرهقا أو تنفيذه مستحيلاً، ومثال ذلك ظهور فيروس كورونا الذي أثر بشكل كبير على تنفيذ العقود. وخلصت الدراسة أن إعلان حالة الطوارئ الصحية أثرت بشكل كبير على تنفيذ العقود، إلى أن جعلت منه مستحيلا وليس مرهقاً. Through this study, we will discuss the extent of the impact of the Corona virus on foreign investment contracts, this virus that has greatly affected the lives of citizens in general and the international and national economy, and the state resorts to implement its economic policy to adopt foreign investment, whether direct or indirect, This is done by contracting with foreign investors, The investment contract guarantees a set of mutual obligations and rights between them, however, when implementing this contract, circumstances outside the scope of the parties may arise that may impede its implementation, and these circumstances, according to the general rules, are nothing but an emergency circumstance, or a force majeure, that may make the commitment exhausted or impossible to implement, An example of this is the emergence of the Corona virus, which greatly affected the implementation of contracts. The study concluded that declaring a state of health emergency greatly affected the implementation of contracts, until it made it impossible and not exhausted.
