التوفيق بين أغراض الضبط الإداري وممارسة حريات الأفراد

الملخص
تتضرر الحريات الفردية بجميع تصرفات الإدارة نظراً لتقييد بعض الممارسات جراء تحقيق المحافظة على النظام العام، لكن تبقى مهمة سلطات الضبط دائما في حرج لفرض أغراض الضبط، لأن استتباب الأمن والسلامة للأفراد يتطلب نوعا من الصلابة والصرامة في عملية اتخاذ القرار وكذا التعجيل في الإجراءات ووسائل التدخل الممكنة، ورغم هذا وذاك تتضارب الآراء حول الانعكاس على الحريات والتعدي عليها؛ حتى وإن كفلتها الدساتير والمنظمات الحقوقية والدولية، ولكن في حقيقة الأمر الغرض من الضبط يسمو ويسبق الحرية، لأن لا يمكن ممارسة حرية بلا أمن ولا صحة ولا طمأنينة، ورغم هذا الصراع إلا أن هناك نوع من التقاطع بين سلطات الضبط والحريات، حول مسألة التضييق وفرض القيود التعسفية في حق بعض الحريات تحت ذريعة المحافظة على النظام العام، وهذا ما نعيشه في غالبية دول العالم، حيث أصبحت كرامة الإنسان تداس دون مراعاة أدنى اعتبار لحريات الأفراد. Individual freedoms are affected by all the administration’s actions due to the restriction of some practices as a result of achieving the preservation public order, but the task of the control authorities always remains in embarrassment to impose the purposes of control, because the establishment of security and safety for individuals requires a kind of rigidity and rigor in the decision-making process as well as expediting the procedures and possible means of intervention. Despite this and that, there are conflicting opinions about the reflection on freedoms and their infringement. Even if the constitutions and international human rights organizations guarantee it, but in fact the purpose of control transcends and precedes freedom, because it is not Despite this conflict, there is a kind of intersection between the control authorities and freedoms, on the issue of narrowing and imposing arbitrary restrictions on some freedoms under the pretext of maintaining public order, and this is what we live in most countries of the world, where human dignity has become trampled without taking into account the slightest consideration for the freedoms of indivuals.
