الملخص
تختلف طبيعة حكم القاضي بفك الرابطة الزوجية بين الكشف والإنشاء حسب كل صورة من صور فك الرابطة الزوجية المحددة في قانون الأسرة الجزائري. ويؤثر هذا الاختلاف في طبيعة حكم القاضي في مسائل عديدة أولها العدة وثبوت النسب للأولاد بعد الفرقة وحق التوارث بين الزوجين في الطلاق الرجعي وإعادة الزواج بعد البينونة وأخيرا مسألة المتابعة الجزائية بخصوص جريمة الزنا. The nature of the judge's judgment on the dissolution of the conjugal bond between disclosure and creation varies according to each of the forms specified in the Algerian Family Law. This difference in the nature of the judge's judgment affects on a number of questions, firstly legal retirement(Idda); established children's filiations after the separation; the right of inheritance between the spouses in the retroactive divorce; repeat marriage after irrevocable divorce; in the last the case of Criminal prosecution for Adultery.
