حماية الورثة من الوصية المخالفة لقواعد الميراث في القانون الجزائري - Protecting The Heirs Against The Will That Violates The Rules Of Succession

الملخص

وضع المشرع الجزائري قواعد تحمي نظام المواريث من عدة نواح أهمها منع استغلال الموصي لنظام الوصية من أجل التحايل على الضوابط المقررة ضمن أحكام الميراث. هذا التحايل يأخذ عدة أشكال؛ فقد يكون في شكل تحيز لأحد الورثة دون البقية؛ أو يصل إلى حد السعي إلى حرمان جميع الورثة.كما يمكن أن يكون ذلك نتيجة لرغبة الموصي في الإحسان حين يمرض ويشعر بأن موته قد اقترب. ومن خلال هذا البحث تم التطرق إلى القواعد التي وضعها المشرع الجزائري حماية للورثة من وصايا مورثهم التي تخالف قواعد الميراث، سواء قواعد القانون المدني أو قانون الأسرة، من خلال عرض لمجموعة من الضوابط التي تحدّ من حرية الموصي من حيث مقدار الوصية وصفة الموصى له، إضافة إلى كيفية مواجهة تصرفات الموصي الصورية التي تستر وصاياه حين أعطاها وصف الوصية وحكمها. Abstract: The Algerian legislator has protected the inheritance system in many ways including preventing the inheritance of the testator to the will to circumvent the rules set out in the inheritance provisions. This circumvention can be in the form of prejudice to one of the heirs over the others, or seeking to deprive all the heirs, or the result of the testator's desire to charity if he feels sick or about to die. In this paper, we examine the rules laid down by the Algerian legislator to protect the heirs of their testator's commandment either the rules of civil law or family law by dealing with a set of disciplines that restrict the freedom of the testator in terms of the recommended commandment and the legatee's character. In addition, we face the testator's simulated acts that cover his commandments in which he calls them the commandment and its rule.
