الملخص
وضع المشرع الجزائري مجموعة من الضوابط لزواج المرأة الجزائرية من الأجنبي أهمها الحصول على رخصة من الوالي، واختلف حول هذه الرخصة هل هي مجرد إجراء شكلي قبل الزواج ولا أثر لها على صحته، أم أنها شرط صحة يؤدي غيابه إلى اعتبار الزواج المبرم دون رخصة زواجا غير صحيح ولا يمكن تثبيته. ومن خلال هذا البحث نبين مضمون هذه الضوابط ونبين طبيعتها القانونية مع عرض لبعض قرارات المحكمة العليا الجزائرية حول هذا الموضوع. The Algerian legislator set a set of requirements for the marriage of an Algerian woman to a foreigner, the most important of which is obtaining a authorization from the Wali, and they disagreed about this authorization, is it just a formality before marriage and has no effect on its validity, or is it a validity condition whose absence leads to considering the marriage concluded as an invalid marriage and It cannot be confirm. In this research, we show the content and legal nature of these requirements, with a presentation of some decisions of the Algerian Supreme Court on this subject.
