الملخص
يكفل القانون الدولي لحقوق الإنسان لكل شخص الحق في أعلى مستوى من الصحة يمكن بلوغه، ويُلزِم الدول بإتخاذ تدابير لمنع تهديد الصحة العامة، وتقديم الرعاية الطبية لمن يحتاجها، ومن المعلوم أن للإنسان حقوق ترقى إلى درجة القداسة فلا يجوز المس بها، أو الإعتداء عليها من طرف الدولة أو الأفراد، لكن مع إعلان حالات الطوارئ الصحية يتم الحد والقيد من الحقوق والحريات التي تحميها الدساتير الوطنية والمواثيق الدولية تفاديا للأخطار التي قد تهدد حياة الأشخاص وسلامتهم. في ظل الظرفية التي تعرفها جل دول العالم والتي تشهد انتشار جائحة كورونا (كوفيد- 19 ) الذي تسبب في إتخاد مجموعة من التدابير العاجلة اللازم اتخاذها لمواجهة تبعات وباء فيروس كورونا، وكذا بالموازاة مع الإجراءات الاحترازية والوقائية التي اتخذتها الدول للحفاظ على سلامة وأمن المواطنين، وبناء على قواعد الإعلان المنظم للصحة العامة لسنة 2005 فإن هذا إلزام قانوني للدول من أجل الاستجابة الفورية لإعلانات طوارئ الصحة العامة، وعليه أدى انتشار فيروس كورونا على المستوى التنظيم الدولي إلى اتخاذ تدابير وقائية واحترازية استثنائية متسارعة لإحتواء العدوى، واصدار أغلب الحكومات اجراءات وعقوبات قانونية صارمة للتأكد من إحترامها. International human rights Law guarantees the right of every person to the highest attainable standard of health,and obligated states to take measures to prevent threats to public health,and to provide medical care to those who need it,and it is known that human beings have the rights that rise to the degree of holiness that cannot be violated or attacked by any part of state or individuals, but with the declaration of health emergencies, the rights and freedoms protected by national constructions and international covenants are limited and restricted, in order to avoid mistakes that might threaten people's lives and safety. In the light of the circumstances known to most countries all over the world, which is witnessing the spread of Corona Pandemic (Covid -19), which has caused a set of urgent measures to be taken to confront the consequences of the Corona virus epidemic , as well as in parallel with the precautionary and preventive measures taken by countries to maintain the citizens' safety and security. And based on The Public Health Regulatory Declaration Rules of 2005, this is a legal obligation for the states to respond immediately to the public health emergency declaration. Accordingly, the spread of Coronavirus at an international organization level,led to the adoption of exceptional precautionary and it's measures to contain infection, and most of governments issued strict legal measures and penalties to ensure their respect.
