الإطار القانوني لبناء المؤسسات الفندقية

الملخص
يعتمد اقتصاد العديد من الدول على الصناعة السياحية، ومن بين أهم أسباب نجاح القطاع السياحي هي توافر الدول على مؤسسات فندقية تضمن الإيواء للأفواج السياحية وبقدرة استيعاب تتوافق بين العرض والطلب.سعت الجزائر من اجل توسيع حظيرة المؤسسات الفندقية على المستوى الوطني ومضاعفة عدد الأسرة المتوافرة بها إلى وضع آليات من شانها تطوير القطاع الفندقي سواء من حيث مضاعفة عدد المؤسسات الفندقية الموجودة ومن حيث تحسين نوعية الخدمة فيها وفقا لمعايير التصنيف الدولية، ومن اجل تحقيق ذلك أصدرت الدولة نصوصا قانونية متعددة الهدف منها تشجيع الاستثمار في المجال الفندقي، تحديد فواعد اقتناء العقار السياحي الموجه للفندقة، تحديد قواعد دقيقة لبناء المؤسسات الفندقية.وتأتي هذه الدراسة لتبيان كيفية تنظيم المشرع لهذه القواعد. Abstract : The economy of many countries depends on the tourism industry, and among the most important reasons for the success of the tourism sector is the availability of countries on hotel establishments that guarantee accommodation for tourist groups with a capacity to accommodate supply and demand. Algeria has endeavored to expand the fold of hotel establishments at the national level and double the number of available beds in them to put in place mechanisms that will develop the hotel sector both in terms of doubling the number of existing hotel establishments and in terms of improving the quality of service in them in accordance with international classification standards. In order to achieve this, the state issued texts that aims to encourage investment in the hotel field, defining the rules for acquiring a tourist property, setting precise rules for building hotel establishments.This study comes to show how the legislator regulates these rules.
