فاعلية حماية حقوق الأطفال في القانون الدولي الجنائي Effectiveness Of The Protection Of Children's Rights In International Criminal Law

الملخص
يهدف هذا المقال إلى دراسة فاعلية الحماية الجنائية للأطفال على مستوى القانون الدولي. وذلك بالتركيز على أخطر التهديدات التي تواجه الأطفال بالاستناد فقط على التقارير والاحصاءات المقدمة من المنظمات العاملة في هذا المجال، والتي كان لها الفضل في تدخل القانون الدولي لتجريمها ووضع الآليات لمكافحتها. لقد تبين تزايد الاهتمام الدولي بحقوق الأطفال ونجحت نصوص الاتفاقيات والآليات في الحد أو التقليل من تلك الأخطار والانتهاكات وخاصة المتعلقة منها بعمالة الأطفال. ولكن ماتزال هناك مخاطر وجرائم تهدد الأطفال كجرائم تجنيد الأطفال وجرائم الحرب والجرائم ضد الانسانية وخاصة جرائم استغلال الأطفال في المواد الإباحية. مما يستلزم ضرورة إعادة النظر في بعض النصوص المتعلقة بحماية الطفل لرفع التناقض الحاصل بينها، مع تفعيل أكثر وتنسيق أدق لبعض الآليات. Abstract: This article aims to study the effectiveness of criminal protection of children at the level of international law, by focusing on the most serious threats to children that have been confirmed by the reports of organizations working in this area, which was credited with the intervention of international law to criminalize them and to establish mechanisms to deal with them. It turns out the growing international interest in the rights of children and the texts of conventions and mechanisms have succeeded in reducing or minimizing such threats and violations, especially those related to child labor. However, there are still risks and crimes that threaten children, such as child recruitment into the armed forces, war crimes and crimes against humanity, especially child pornography, which requires the need to review some provisions on child protection to raise the contradiction between them, with more activation and more accurate coordination between some mechanisms. Résumé: Cet article vise à étudier l'efficacité de la protection pénale des enfants au niveau du droit international. En se concentrant sur les menaces les plus graves auxquelles sont exposés les enfants, sur la seule base des rapports et statistiques fournis par des organisations travaillant dans ce domaine, à qui est attribuée l'intervention du droit international pour les criminaliser et pour mettre en place des mécanismes pour les combattre. Il s'avère que l'intérêt international croissant pour les droits des enfants et les textes des conventions et mécanismes ont permis de réduire ou de minimiser ces menaces et violations, en particulier celles liées au travail des enfants. Cependant, il existe toujours des risques et des crimes qui menacent les enfants, tels que le recrutement d'enfants dans les forces armées, les crimes de guerre et les crimes contre l'humanité, en particulier la pornographie. ce qui nécessite de revoir certaines dispositions relatives à la protection de l'enfance afin de lever la contradiction qui existe entre elles, avec plus d'activation et une coordination plus précise entre certains mécanismes.
