الملخص

الملخص: لقد قدمت المحاكم الجنائية الدولية أنموذجا ليس الأحسن ولكنه ألأرقي إذا ما قورن بمحاكم الحرب العالمية الثانية، لقد مكنت تجربة المحاكم الجنائية الدولية من إعطاء دفع قوي للقانون الدولي الجنائي عبر توضيح مصادر القاعدة الجنائية الدولية وهي المصادر الرسمية والمصادر التكميلية عند الفصل في الدعوى الجنائية المنظورة، ما مكن من حسم مسالة مهمة تتمثل في مصادر القانون الدولي الجنائي. تمثل تجربة المحاكم الجنائية الدولية قرينة قاطعة أولا علي إمكانية قيام قانون جنائي دولي يتوافر على شق مادي وآخر إجرائي يماثل القانون الجنائي في الأنظمة الجنائية الوطنية ، ثانيا يمكن هذا النظام القانوني من تحقيق قمع جنائي دولي فعلي وفعال يسهم في تحقيق احترام لحقوق الإنسان. الكلمات المفتاحية: المحاكم الجنائية الدولية، مصادر القانون الجنائي الدولي، المصادر الاساسية، المصادر التكميلية. Abstract : The international criminal courts have provided a model that is not the best, but it is the most prestigious if compared to the courts of World War II. The experience of the international criminal courts has enabled a strong impetus to international criminal law by clarifying the sources of the international criminal rule, which are the official sources and the complementary sources when deciding the pending criminal case, what It enabled the resolution of an important issue represented in the sources of international criminal law. The experience of international criminal courts represents conclusive evidence first of the possibility of establishing an international criminal law that has a material and procedural aspect similar to criminal law in national criminal systems Secondly, this legal system enables effective and effective international criminal repression that contributes to achieving respect for human rights.
