منح العقار الاقتصادي الموجه للاستثمار في ظل القانون الجديد 17/23

الملخص
أطلقت الوكالة الجزائرية لترقية الاستثمار بتاريخ 08 فيفري 2024 المنصة الرقمية الخاصة بالعقار الإقتصادي ، و هو ما يعتبر إمتدادا لسياسة و جهود الدولة في الإنتقال من الإدارة الكلاسيكية التقليدية إلى الإدارة الرقمية الحديثة و هذا من أجل إضفاء شفافية أكثر على منح العقار الصناعي ، و تتجلى أهمية هذا الأخير كونه يلعب دورا كبيرا في إقامة المشاريع و استقطاب المستثمرين، ولذلك عملت الجزائر على وضع الاطار القانوني الذي ينظم آليات منح الأوعية العقارية الموجهة للاستثمار و الذي يتناسب و توجهاتها الاقتصادية، وقد تم اصدار العديد من القوانين التي تناولت طرق الحصول على العقار و لعل أهمها القانون 08/04 الذي يحدد شروط و كيفيات منح الامتياز على الأراضي التابعة للأملاك الخاصة للدولة، و نظر للعيوب الذي ظهرت مع تطبيق هذا الأخير و نتيجة للسلبيات التي صاحبته على أرض الواقع ارتأى المشرع لسن قانون جديد23/17 المؤرخ في 15 نوفمبر2023 ليكون دافعا لتشجيع الاستثمار في الجزائر، وقد خول هذا القانون و منح للوكالة الجزائرية لترقية الاستثمار سلطة منح العقار الاقتصادي. On February 8, 2024, the Algerian Investment Promotion Agency launched the digital platform for economic real estate, which is considered an extension of the state’s policy and efforts in moving from traditional classical management to modern digital management, in order to add more transparency to industrial real estate grants, and the importance of this is evident. The latter is because it plays a major role in establishing projects and attracting investors. Therefore, Algeria has worked to establish a legal framework that regulates the mechanisms for granting real estate properties directed to investment that are appropriate to its economic orientations. Many laws have been issued that deal with methods of obtaining real estate, perhaps the most important of which is the law. 08/04, which specifies the conditions and methods for granting concessions on lands belonging to private property of the state, and in view of the defects that appeared with the application of the latter and as a result of the negatives that accompanied it on the ground, the legislator decided to enact a new law 23/17 dated November 15, 2023 to be an incentive to encourage investment in Algeria: This law authorized and granted the Algerian Investment Promotion Agency the authority to grant economic real estate
