نفقة الطفل المحضون على ضوء أحكام القانون 01/24

الملخص
من بين أهم أثار الطلاق و فك الرابطة الزوجية الحضانة و ما تحمله من مصالح و جب تحقيقها و توفيرها للطفل المحضون ، من رعاية مادية و نفسية و العمل على تعليمه و تربيته و حمايته من كل أشكال التعدي التي يمكن أن يتعرض لها خاصة ما تعلق منها بالنفقة و ما يترتب عن عدم تسديدها من مشاكل للحاضنة و المحضون، و لعل من بين أهم الأسباب التي تؤدي إلى التملص من هذه المسؤولية منها ما يرجع إلى تخلي بعض الأزواج عن مسؤلياتهم تجاه أبنائهم ومنها ما يرجع إلى عدم قدرة هؤلاء على التسديد، ولهذا عمل المشرع الجزائري على إحاطة المحضون بجملة من الآليات و الوسائل التي تضمن عدم إلحاق الضرر به، وتجسد ذلك بصدور العديد من القوانين منها القانون 15/01 و المتضمن إنشاء صندوق النفقة و الملغى بموجب القانون محل الدراسة 24/01 و الذي يتضمن تدابير خاصة للحصول على النفقة، و تهدف هذه الورقة البحثية إلى تسليط الضوء على أهم الأحكام التي جاء بها هذا القانون الجديد. Among the most important effects of divorce and dissolution of the marital bond is custody and the interests it entails that must be achieved and provided to the child in custody, such as material and psychological care, working to educate him, raise him, and protect him from all forms of abuse to which he may be exposed, especially those related to alimony. And the problems that result from failure to pay it for the custodian and the child in custody, and perhaps among the most important reasons that lead to evading this responsibility is what is due to some spouses abandoning their responsibilities towards their children, and some of them are due to the inability of these people to pay, and for this reason the Algerian legislator worked To inform the child of a set of mechanisms and means that ensure that no harm is caused to him, and this was embodied in the issuance of many laws, including Law 15/01, which included the establishment of the alimony fund, which was repealed under the law under study 24/01, which included special measures to obtain alimony, and This research paper aims to shed light on the most important provisions of this new law.
