قرار الهدم آلية قانونية لحماية أراضي الدولة من التعدي و إقامة البناءات و المنشآت غير شرعية في ظل القانون الجديد 18/23.

الملخص
نظرا للإنتشار الواسع للبناءات الفوضوية و للأحياء القصديرية و المقامة بشكل عشوائي و بصفة غير شرعية و غير قانونية على أراضي تابعة للدولة، مما أثر تأثيرا واضحا و مباشرا على البيئة بجميع عناصرها بشكل يهدد سلامة الأشخاص و ممتلاكاتهم، ناهيك عن الإختلال الكبير في النسيج العمراني و المظهر الجمالي له، كان لزاما على المشرع التدخل و وضع آليات من خلالها يتم منع إنتشار مثل هذه السلوكات، و تجسد ذلك بصدور العديد من القوانين ذات الصلة كان آخرها القانون 23/18 و المتعلق بحماية أراضي الدولة و المحافظة عليها، و الذي من خلاله أكد المشرع على آلية الهدم كوسيلة قانونية للحد من التعدي و إقامة بناءات و منشآت غير شرعية، و تهدف هذه الورقة البحثية إلى تسليط الضوء على قرار الهدم في ظل القانون 23/18 و دوره في حماية الأراضي و المحافظة على البيئة بجميع عناصرها. Due to the widespread spread of chaotic buildings and tin neighborhoods erected randomly, illegally, and illegally on lands belonging to the state, which has a clear and direct impact on the environment with all its elements, threatening the safety of people and their property, not to mention the major imbalance in the urban fabric and aesthetic appearance. This led to the need for the legislator to intervene and establish mechanisms through which the spread of such behavior is prevented, and this was embodied in the issuance of many relevant laws, the most recent of which was Law 23/18, relating to the protection and preservation of state lands, through which the legislator affirmed on the demolition mechanism as a legal means to limit encroachment and the establishment of illegal buildings and facilities. This research paper aims to shed light on the demolition decision under Law 23/18 and its role in protecting lands and preserving the environment with all its elements.
