Countermeasures In Response To Internationally Wrongful Act

Abstract
Countermeasures are considered an effective means of stopping internationally wrongful acts and resolving international disputes peacefully, .they serve as a tool for states to protect their own interests when international organizations and international courts fail to act Therefore countermeasures are a legitimate right of states in international law, they differ from sanctions, self-defense, necessity, andeconomic measures, resorting to countermeasures is subject to certain conditions, however they cannot be exercised against certain categories of .obligations identified by the International Law commission in its 2001 draft articles on responsibility of states for Internationally wrongful acts تعتبر التدابير المضادة وسيلة فعالة لوقف الفعل غير المشروع دوليا وحل المنازعات الدولية بالطريقة السلمية، حيث أنها أداة في يد الدول لحماية مصالحها المتضررة بنفسها بعد ثبوت تقاعس المنظمات الدولية والقضاء الدولي في الكثير من الأحيان، لذلك فإن التدابير المضادة حق مشروع للدول في القانون الدولي وهي تختلف عن كل من: الجزاء والدفاع الشرعي وحالة الضرورة والتدابير الإقتصاصية، واللجوء إليها يكون وفقا لشروط، على أنه لا يجوز ممارستها على فئة من الالتزامات حددتها لجنة القانون الدولي في مشروعها حول مسؤولية الدول عن الأفعال غير المشروعة دوليا لعام 2001 .
