دور البيئة في ظهور مصطلح قانوني جديد للاجئ "اللجوء البيئي"

الملخص
ملخص: تهدف هذه الدراسة إلى إضفاء الصورة الحقيقة والقانونية على الممارسات الانسان غير العقلانية اتجاه البيئة والتي من شأنها أن تؤدي إلى تدهور البيئة بصفة عامة و تغير المناخ بصفة خاصة والذي يعتبر احد الاسباب الرئيسية للهجرة في العالم ومن ثمة ظهور نوع جديد من اللاجئين" البيئيين ". وعلى إثر دراستنا لهذا الموضوع ،توصلنا إلى نتيجة مفادها أن المشرع الجزائري وعلى غرار التشريعات المقارنة لم يتطرق الى هذه الفئة و التي تحمل اسم اللاجئ البيئي ، الا ان الظروف المحيطة بالإنسان و المرتبطة ارتباطا وثيقا بالبيئة و المناخ تحتم ضرورة الاهتمام بهذا الموضوع الجديد في الساحة الدولية و الوطنية. Abstract: This study aims to give a true and legal picture of irrational human practices towards the environment, which would lead to environmental degradation in general and climate change in particular, which is one of the main causes of migration in the world, and hence the emergence of a new type of "environmental" refugee. As a result of our study of this subject, we came to the conclusion that the Algerian legislator, similar to the comparative legislation, did not address this category, which bears the name of the environmental refugee. However, the circumstances surrounding the human being and closely related to the environment and climate necessitate the need to pay attention to this new issue in the international arena. and patriotism.
