الملخص
باعتبار المضاربة الغير مشروعة جريمة خطيرة تهدد الجانب الاقتصادي والاجتماعي الغرض منها التخريب وعرقلة الأوضاع، إضافة إلى زعزعة الاستقرار داخل الدولة، إذ أن عدم استقرارا الأسعار واضطرابها يؤدي إلى عدم استقرار السوق مما يؤثر على المنافسين والمستهلك في آن واحد، ولما كان المتضرر الأول هو الشعب في نظر الدولة، وبسبب عدم قدرة المواد 172، 174، 173 من قانون العقوبات على محاربة هذه الجريمة قام المشرع الجزائري بإلغائها واستحداث قانون رقم21-15 المؤرخ في 28 ديسمبر 2021، يتعلق بمكافحة المضاربة غير المشروعة، ورد فيه أهم صور المضاربة غير مشروعة وأركانها كما تطرق إلى العقوبات ضد الأشخاص القائمين عليها سواء كانوا أشخاص طبيعيين (فرد) أو معنويين (شركة) مثلا، وبالرغم من انه مستقل بقواعده وأحكامه إلا انه يخضع لقانون العقوبات في جوانب معينة. Abstract: Considering that illegal speculation is a serious crime that threatens the economic and social aspect, the purpose of which is to sabotage and obstruct the situation, in addition to destabilizing the country, as price instability and turbulence leads to market instability, which affects competitors and the consumer at the same time, and since the first affected is the people in In view of the state, and due to the inability of Articles 172, 174, and 173 of the Penal Code to combat this crime, the Algerian legislator repealed it and introduced Law No. 15-21 of December 28, 2021, related to combating illegal speculation, in which it stated the most important forms of illegal speculation and its elements, as touched upon To penalties against the persons in charge of it, whether they are natural persons (individual) or legal persons (company), for example, and although it is independent by its rules and provisions, it is subject to the Penal Code in certain aspects.
