تعديل الكراء التجاري كضمانة لبقاء الأصل التجاري

الملخص
يعد تعديل الحق في الكراء ضمانة أساسية لبقاء الأصل التجاري المتألف إلزاما من الزبناء القارّين والعارضين الذين لا تمكن المحافظة عليهم إلا في ظل تجديد حق الكراء وتعديله إذا تطلب الأمر ذلك وفق الضوابط والشروط المختلفة تبعا لاختلاف أنماط التعديل. وبهذا التعديل نكون أمام قيمة كرائية عادلة مصدرها الاتفاق أو القضاء، تعطي توازنا حقيقيا بين الملكية التجارية والملكية العقارية، ويترتب على تلك القيمة العادلة بقاء واستمرار الأصل التجاري باعتباره مؤسسة تجارية كانت ولا تزال محور الأنشطة الاقتصادية من إنتاج وتوزيع وخدمات. وهو ما يجعل من بقاء واستمرار الأصل التجاري هدفا يسعى إليه المشرع الموريتاني كغيره من التشريعات الأخرى، وما ذلك إلا لما ينجر عن حماية الأصل التجاري من المزايا العامة والخاصة. Summary Modifying the right to rent is a basic guarantee for the survival of the commercial asset that is compulsory from permanent customers and exhibitors, who can only be preserved under the renewal of the right to rent and amend it if necessary according to the different controls and conditions according to the different patterns of modification. With this amendment, we are faced with a fair rent value, the source of which is the agreement or the judiciary, that gives a real balance between commercial ownership and real estate ownership, and that fair value entails the survival and continuity of the commercial asset as a commercial enterprise that was and still is the focus of economic activities of production, distribution and services. This is what makes the survival and continuity of the commercial asset a goal that the Mauritanian legislator seeks to achieve, like other legislations, and this is only because of the protection of the commercial asset from public and private benefits.
