الملخص
يهدف هذا البحث إلى بيان قاعدة "الأصل في الأشياء الحل"، وهي من القواعد الفقهية المهمة في بابها، وذلك لاشتمالها على مسائل كثيرة وأحكام متنوعة، وهي تمثل ثلث الأحكام، وذلك أن الأحكام لا تخلو من واحد من هذه الأمور، إما أن تكون حلالا، أو حرما، أو مسكوتا عنها، وقد وردت هذه القاعدة بعدة صيغ وألفاظ تدل على شهرتها، ويزيدها شهرة كثرة الأدلة التي تدل على صحتها من الكتاب والسنة والإجماع، وتطبيقات هذه القاعدة كثيرة ومتنوعة، ومن ذلك تطبيقها على "الأصل في اللحوم". ومما خلص إليه البحث، أنه لا بد من التفريق بين الحيوان واللحوم، فالحيوان الأصل فيه الحل، وهو محل تطبيق القاعدة، وأما اللحوم فالأصل في التحريم، لورود الأدلة في ذلك.
