رد الأعيان المعقود عليها، دراسة في الأسباب Returning The Contracted-upon Objects-study Of Causes

الملخص
قد يتعثر العقد لأي سبب من الأسباب فلا تترتب عليه آثاره، مما يستوجب العودة إلى الحال الذي كان قبل العقد، مما يستلزم رد محل العقد الذي قد يكون عينا معقودا عليها. وتهدف هذه الدراسة إلى استجلاء الأسباب الموجبة لرد الأعيان المعقود عليها، وإبراز أثر تلك الأسباب في الرد، وقد توصلت الدراسة إلى أن أهم أسباب رد الأعيان المعقود عليها ثمانية، تم بيانها في ثنايا الدراسة. The contract can fail for any reason, which makes its effects invalid, and makes it a must that the case returns to the shape it has been before dealing the contract, and therefore makes it a must that the contracted-upon object to be returned if it was physical. This study aims to clear out the leading causes behind returning the contracted-upon objects, and to highlight the effect of the causes in returning. The study has concluded that the causes of returning contracted-upon physical objects are eight, which have been stated through the study.
