تفسير وبيان مجمل النصوص وأثره في الفقه الإسلامي . Interpretation And Statement Of All Texts And Their Impcat On Islamic Jurisprudence

الملخص
الملخص: إن التشريع الإسلامي يرد بألفاظ وكلمات موجهة للمكلفين والمخاطبين وهذه الألفاظ قد تكون واضحة المعنى والدلالة للسامع والقارئ وقد تكون خافية المعنى، ومبهمة الدلالة، وهنا يأتي دور المفسرين والشراح الذين يسعون لمعرفة مراد الشرع من النص، وتحديد الحكم المطلوب تنفيذه، وقد قسم علماء الأصول اللفظ باعتبار ظهور معناه وخفائه إلى قسمين: واضح الدلالة، ومبهم الدلالة، أي دلالة اللفظ بنفسه على المراد منه أو دلالته بأمر خارجي، وقد قسم الجمهور (المتكلمون) المبهم إلى نوعين: المجمل والمتشابه، وهو رأي الأكثرين، ويرى بعض المتكلمين أن المبهم هو المجمل فقط وأن المتشابه هو نوع من أنواعه. وقد جاءت هذه الورقة لتسليط الأضواء الكاشفة على مصطلح المفسر والمبين من خلال بيان مفهوم المجمل وأسباب الإجمال، ثم مفهوم المفسر والمبين، مع الاشارة إلى أن المفسر لم يشتهر عند الجمهور في معنى معين، كما اشتهر عند الحنفية، وأن مصطلح المفسر مرادف للمبين، مع بيان أقسامه، مع ذكر نماذج لبيان تفسير المجمل وأثره في الفروع الفقهية، وصولا إلى الخاتمة التي تشتمل أهم النتائج والتوصيات. الكلمات المفتاحية: المجمل؛ المبين؛ المفسر؛ المتشابه؛ فرض الوضوء. Abstract Islamic legislation responds with expressions and words addressed to those charged and addressed, and these expressions may be clear in meaning and connotation to the listener and the reader, and may be hidden in meaning, and the connotation is vague, and here comes the role of interpreters and commentators who seek to know the intent of the Sharia from the text, and to determine the ruling required to be implemented. The appearance of its meaning and its concealment into two parts: the clear signification, and the vague signification, i.e. the signification of the utterance by itself on what is meant by it or its signification by an external command. Similar is one of a kind. This paper came to shed revealing lights on the term interpreter and explained by explaining the concept of the totality and the reasons for totality, then the concept of the interpreter and the explained, with reference to the fact that the interpreter was not well known to the public in a specific meaning, as it was known to the Hanafis, and that the term interpreter is synonymous with the clear, with a statement Its sections, with mentioning models to explain the interpretation of the overall and its impact on the jurisprudential branches, leading to the conclusion that includes the most important findings and recommendations.
