الملخص
ملخص: يعد القضاء الملاذ الوحيد للمظلومين في ظل الدولة الحديثة، فلا حديث عن استقلالية مرفق القضاء إن لم يوجد نظاما قانونيا يوفر الضمانات الأساسية لذلك، ولعل أهم معرقل لهذه القاعدة هو غياب مبدأ الفصل ما بين السلطات، الذي يعد من بين المواضيع التي حصل حولها جدل كبير بين فقهاء القانون الدستوري. الأمر لم يتوقف عند هذا الحد، وإنما التحدي الكبير الذي بات يواجه مبدأ استقلالية القضاء أيضا هو مدى استقلالية القضاء أيضا عن السلطة السياسية، أو بعبارة أخرى تأثير السلطة السياسية على مرفق القضاء، وجعله أداة في يدها. Abstract : The judiciary is the only refuge for the oppressed in the light of the modern state. There is no talk of the independence of the judiciary if there is no legal system that provides basic guarantees for that. Constitutional law jurists. The matter did not stop at this point, but rather the great challenge facing the principle of the independence of the judiciary also is the extent of the independence of the judiciary also from the political authority, or in other words the influence of the political authority on the facility of the judiciary, and making it a tool in its hand.
