الملخص
ملخص: نحاول من خلال هذا الموضوع دراسة مدى استقلالية هيكل بنك الجزائر من جانبه القانوني، باعتباره العمود الفقري للنشاط البنكي في الدولة، ويقصد بالاستقلالية هنا طريقة تعيين تشكيلة بنك الجزائر و كيفيات عزلها، وامتيازات أعضائها، وأهم الصلاحيات المخولة لها، ومدى تداخل هذه الصلاحيات فيما بينها، وعلاقاتها مع بعضها البعض. والقول بهيكل البنك المركزي بين السلطة والحرية، يعني مدى تدخل السلطة التنفيذية أو سلطة أخرى في عمل البنك من جهة، وحريته في مباشرة مختلف صلاحياته المنصوص عليها في قانون النقد والقرض من جهة أخرى. ولعل هذه الدراسة تهدف إلى: - تجنّب الخلط و التمييز بين الأجهزة المكونة لبنك الجزائر والأجهزة المساعدة له. - مدى استقلالية تشكيلة هيكل بنك الجزائر. - معرفة مدى تمكن تشكيلة بنك الجزائر عن طريق الأنظمة من تأسيس القانون البنكي. - مدى نجاح المنظومة القانونية المصرفية في الوصول إلى فكرة استقلالية بنك الجزائر عن السلطة التنفيذية. Summary: Through this topic, we are trying to study the extent of the independence of the Bank of Algeria’s structure from its legal side, as it is the backbone of the banking activity in the country. Independence here means the method for determining the composition of the Bank of Algeria, the methods of its isolation, the privileges of its members, the most important powers vested in it, the extent of the overlap of these powers among themselves, and their relations With bitten another. The saying of the structure of the central bank between the authority is free, it means the extent of interference by the executive authority or another authority in the work of the bank on the one hand, and its freedom to exercise its various powers stipulated in the Monetary and Loan Law on the other hand. Perhaps this study also aims to: -Avoid confusing and distinguishing between the components of the Bank of Algeria and its auxiliary systems. -The extent of the independence of the composition of the Bank Algeria structure. - Knowing the extent to which the composition of the Bank of Algeria could, through the regulations, establish the banking law.
