الخصوصية الاجرائية للدعوى العمومية في قانون مكافحة الفساد

الملخص
الدعوى العمومية هي مجموعة من الاجراءات القضائية التي يحددها القانون، حيث تعد مرحلة الاتهام المرحلة الاولى من مراحل الدعوى العمومية وتقوم بتحريكها النيابة العامة بحسب الأصل باعتبارها سلطة الاتهام ،إلا أن جرائم الفساد عرفت خصوصية تتعلق بالدعوى العمومية في اطار هذه المرحلة، وذلك من خلال التقييد من سلطة و حرية النيابة العامة عن طريق اجراء يخرج عن اطار القواعد المتعارف عليها، و يتمثل هذا الاجراء بالأساس في وجوب الحصول على الموافقة المسبقة من اجل اتمام المراحل المتبقية للدعوى العمومية او بعدم جدوى مباشرتها، هذا وقد استحدث المشرع ضمن قانون الوقاية من الفساد ومكافحته وقانون الاجراءات الجزائية أيضا، اجراءات خاصة منها ما هو متعلق بالتحري عن جرائم الفساد والتي لم تكن معروفة من قبل وايضا مدى امكانية توسيع الاختصاص المحلي عن طريق انشاء محاكم ذات الاختصاص الموسع. The public lawsuit is a group of judicial procedures defined by the law, where the indictment stage is the first stage of the public lawsuit, and it is initiated by the Public Prosecution, according to the original, as it is the accusing authority, However, corruption crimes knew a specificity related to the public lawsuit within the Framework of This stage, by restricting the authority and freedom of the Public Prosecution through a procedure that deviates from the framework of the accepted rules,This procedure basically consists in the necessity of obtaining prior approval in order to complete the remaining stages of the public lawsuit or if it is not feasible to proceed with it.The legislator has introduced, within the Law on Prevention and Combating Corruption and the Law of Criminal Procedures as well, special procedures, including what is related to the investigation of corruption crimes that were not known before, and also the extent to which local jurisdiction can be expanded by establishing courts with expanded jurisdiction
